Province to Amend Family Maintenance Act
In order to comply with a Supreme Court of Canada decision regarding the definition of a spouse, Justice Minister Michael Baker is amending Nova Scotia's Family Maintenance Act. The act addresses the right to maintenance after the breakdown of a relationship and will now include same-sex couples.
In the case of M. vs. H., the Supreme Court of Canada focused on the legal rights of same-sex couples in the area of maintenance under the Family Law Act of Ontario. Nova Scotia's amendment ensures the provisions in the Family Maintenance Act are consistent with the provisions reviewed by the Supreme Court.
Like other jurisdictions, Nova Scotia will continue to review statutes that may be applicable to ensure compliance with the Supreme Court decision.
Nova Scotia currently recognizes same-sex couples with respect to provincial pensions.
