Michelin Certification Bid Dismissed

After reviewing written submissions from Michelin and CAW-Canada, the Nova Scotia Labour Relations Board decided at a meeting today that the union's application of certification as filed will be dismissed with a one-year time bar.

Reasons for the order, effective immediately, will follow shortly.

CAW-Canada -- the National Automobile, Aerospace, Transportation and General Workers' Union of Canada -- had filed an application March 11 for certification of certain employees of Michelin North America (Canada) Inc. The board made a preliminary finding that the union had not met the 40 per cent requirement stipulated by Sec. 23 of the Trade Union Act.

As a result, the union reviewed the official list of Michelin employees and filed a submission with the board contesting the inclusion of certain job classifications on the list.

In response to this submission, the labour relations board scheduled hearings for March 22 and 23 to consider issues directly related to the 40 per cent requirement. The union subsequently filed a letter with the board seeking to withdraw the application for certification.

Today's order came after the board asked the union and the employer to file written submissions regarding whether the application for certification should be withdrawn or dismissed and the duration of a time bar if any.
